Traveline Travel Services Terms of Use


I. Definitions
"Traveline Travel Services" means Traveline Travel Services, its predecessors, subsidiaries and affiliates and their respective directors, officers, shareholders, employees, agents, members, representatives, successors and assigns.
Traveline Travel Services "web-based applications and web sites" will be referred to in this document as "platform".
"Services" are offerings from the Traveline Travel Services platform.


II. Limitations on Use of Platform and Services
The Traveline Travel Services platform and services are for business use and in accordance with the terms and conditions of this agreement. As a condition of this agreement, you will not use the platform or services for any illegal purpose. Specifically, you may not modify, copy, distribute, transmit, publish, display, license, create derivative works from or sell any product, services, information or software obtained from the platform or services.


III. Links to Non-Traveline Travel Services Applications and Web sites
Our platform may contain links to applications or web sites operated by parties other than Traveline Travel Services. Those links are provided to you for your reference and convenience only. Traveline Travel Services does not own or control the content of those applications and web sites nor is responsible for their content or your use of them.


IV. Communication


Traveline Travel Services Platform and Services You consent to receive communications from the Traveline Travel Services platform or services. With any form of communication, you have the option to opt-out of future communications. We will communicate with you by posting notices on our platform, email and/or fax. You agree that all notices, disclosures, agreements, and other communications that we provide to you electronically, or by fax satisfy any legal requirements that communications be in writing.


Newsletters If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address.


Service Announcements On occasion, it is necessary to send out a strictly service related announcement. For instance, if our platform or services are temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications.


Customer Service We communicate with users and customers on a regular basis to provide requested services and in regards to issues relating to their account we reply via email, fax or telephone call, in accordance with the terms of this agreement.

ALL OF THE INFORMATION PROVIDED BY THE TRAVELINE TRAVEL SERVICES PLATFORM AND SERVICES IS PROVIDED "AS-IS" ANDWITH NO WARRANTIES. TRAVELINE TRAVEL SERVICES MAKES NO REPRESENTATIONS NOR EXTENDSWARRANTIES OF ANY TYPE AS TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION OR CONTENT WITHIN THE TRAVELINE TRAVEL SERVICES PLATFORM AND SERVICES.

IN NO EVENT SHALL TRAVELINE TRAVEL SERVICES OR ANY OF ITS SUBSIDIARIES AND AFFILIATES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, MEMBERS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS BE LIABLE FOR ANY INDIRECT, SPECIAL INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR DIRECTLY OR INDIRECTLY RELATED TO THE USE OF ACCURACY, OR THE INABILITY TO USE TRAVELINE TRAVEL SERVICES'S PLATFORM AND SERVICES.

TRAVELINE TRAVEL SERVICES GLOBAL PRIVACY POLICY
Traveline Travel Services respects individual privacy and values the confidence of its customers, employees, vendors, business partners and others. Traveline Travel Services strives to collect, use and disclose Personal Identifiable Information/Sensitive Personal Identifiable Information (PII/SPII) in a manner consistent with the laws of the countries in which it does business and has a tradition of upholding the highest ethical standards in its business practices. Traveline Travel Services abides by the Safe Harbor Privacy Principles developed by the U.S. Department of Commerce and the European Commission and the Frequently Asked Questions (FAQs) issued by the Department of Commerce on July 21, 2000 (collectively the "U.S.-EU Safe Harbor Framework"). This Safe Harbor Privacy Policy (the "Policy") sets forth the privacy principles that Traveline Travel Services follows with respect to transfers of PII/SPII anywhere in the world, including transfers from the European Economic Area (EEA) (which includes the twenty-seven member states of the European Union (EU) plus Iceland, Liechtenstein and Norway) to the United States.


I. Safe Harbor/Enforcement
The United States Department of Commerce and the European Commission have agreed on a set of data protection principles and frequently asked questions (the "U.S.-EU Safe Harbor Framework") to enable US companies to satisfy the requirement under European Union law that adequate protection be given to PII/SPII transferred from the EU to the United States. The European Economic Area ("EEA") also has recognized the US-EU Safe Harbor Framework as providing adequate data protection (OJ L 45, 15.2.2001, p.47). Consistent with its commitment to protect Personal privacy, Traveline Travel Services adheres to the Safe Harbor Privacy Principles and has certified its compliance. Traveline Travel Services has a Chief Privacy Officer who is responsible for Traveline Travel Services' compliance with and enforcement of this Policy and data security issues. Traveline Travel Services educates its employees concerning compliance with this Policy and has self-assessment procedures in place to assure compliance. Traveline Travel Services' Chief Privacy Officer is available to any of its valued customers, employees, vendors, business partners and others who may have questions concerning this Policy or data security practices. II. Scope
This Policy applies to all PII/SPII received by Traveline Travel Services in any format including electronic, paper or verbal. As an integral part of its business, Traveline Travel Services collects and processes PII/SPII from its customers and potential customers in a variety of ways, including manually, via telephonic means (including facsimiles), electronic mail or its platform and services.


Traveline Travel Services will not sell or share this information with third parties in ways different than what are disclosed in this Privacy Policy. On a national basis, Traveline Travel Services will, and will cause its business partners to, establish and maintain business procedures that are consistent with this Policy.


PII/SPII collected by Traveline Travel Services from prospective customers and customers may be maintained at its Data Centers in Willoughby, Ohio. Traveline Travel Services collects PII/SPII for, among other things, legitimate business reasons such as customer service, travel related reporting and records requirements, maintenance of accurate accounts payable and receivable records, and performance management, financial and sales data, and contact information. All PII/SPII collected by Traveline Travel Services will be used for legitimate business purposes consistent with this Policy.


III. Definitions
For purposes of this Policy, the following definitions shall apply:
"Agent" means any third party that uses PII/SPII provided by Traveline Travel Services to perform tasks on behalf of or at the instruction of Traveline Travel Services.


"Personal Identifiable Information (PII)" means any information or set of information that identifies or could be used by or on behalf of Traveline Travel Services to identify an individual. It does not include information that is encoded or anonymized, or publicly available information that has not been combined with non-public Personal information.
"Sensitive Personal Identifiable Information (SPII)" means Personal Identifiable Information, which if lost, compromised, or disclosed without authorization, could result in substantial harm, embarrassment, inconvenience, or unfairness to an individual.


IV. Privacy Principles
The privacy principles in this Policy are based on the seven Safe Harbor Privacy Principles.


NOTICE: Where Traveline Travel Services collects PII/SPII directly from individuals, it will inform them about the purposes for which it collects and uses that information about them, the types of non-agent third parties to which Traveline Travel Services discloses that information, and the choices and means, if any, Traveline Travel Services offers individuals the ability to limit the use and disclosure of their PII/SPII. Notice will be provided in clear and conspicuous language when individuals are first asked to provide PII/SPII to Traveline Travel Services, or as soon as practicable thereafter, and in any event before Traveline Travel Services uses the information for a purpose other than that for which it was originally collected. Traveline Travel Services may disclose PII/SPII if required to do so by law or to protect and defend the rights or property of Traveline Travel Services.


CHOICE: Traveline Travel Services will offer individuals the opportunity to choose (opt-out) whether their PII/SPII is (a) to be disclosed to a non-agent third party, or (b) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual.
For SPII information, Traveline Travel Services will give individuals the opportunity to affirmatively and explicitly (opt-in) consent to the disclosure of the information to a non-agent third party or to the use of the information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual.
Traveline Travel Services will provide individuals with reasonable mechanisms to exercise their choices should requisite circumstances arise.


DATA INTEGRITY: Traveline Travel Services will use PII/SPII only in ways that are compatible with the purposes for which it was collected or subsequently authorized by our customers. Traveline Travel Services will take reasonable steps to ensure that PII/SPII is relevant to its intended use, accurate, complete, and current.


TRANSFERS TO AGENTS: Traveline Travel Services will obtain assurances from its Agents that they will safeguard PII/SPII consistently with this Policy. Examples of appropriate assurances that may be provided by Agents include: a contract obligating the agent to provide at least the same level of protection as is required by the relevant Safe Harbor Privacy Principles, being subject to EU Directive 95/46/EC (the EU Data Protection Directive), Safe Harbor certification by the agent, or being subject to another European Commission adequacy finding (e.g., companies located in Hungary and Switzerland). Where Traveline Travel Services has knowledge that an Agent is using or disclosing PII/SPII in a manner contrary to this Policy, Traveline Travel Services will take reasonable steps to prevent or stop the use or disclosure. Traveline Travel Services holds it Agents accountable for maintaining the trust its employees and customers place in the Company.


ACCESS AND CORRECTION: Upon request, Traveline Travel Services will grant individuals reasonable access to PII/SPII that it holds about them. In addition, Traveline Travel Services will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete. Any customer who desires to review, correct or delete their information can do so by contacting Traveline Travel Services, Account Management, 4074 Erie Street, Willoughby, OH 44094.


SECURITY: Traveline Travel Services will take reasonable precautions to protect PII/SPII in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. Security is designed to prevent unauthorized access to database equipment and hard copies of PII/SPII and to monitor access to its servers to provide protection from hacking or other unauthorized access.
Traveline Travel Services limits access to PII/SPII and data to those persons in Traveline Travel Services' organization, or Agents of Traveline Travel Services, that have a specific business purpose for maintaining and processing such information and data. Individuals who have been granted access to PII/SPII are aware of their responsibilities to protect the security, confidentiality and integrity of that information.


ENFORCEMENT: Traveline Travel Services will conduct reviews of its relevant privacy practices to verify adherence to this policy and the US Department of Commerce Safe Harbor Privacy Principles. Any employee who Traveline Travel Services determines is in violation of this policy will be subject to disciplinary action.


V. Dispute Resolution
Any questions or concerns regarding the use or disclosure of PII/SPII should be directed to the Traveline Travel Services Chief Privacy Officer at Traveline Travel Services, 4074 Erie Street, Willoughby, OH 44094. Traveline Travel Services will investigate and attempt to resolve complaints and disputes regarding use and disclosure of PII/SPII in accordance with the principles contained in this Policy and shall be governed by, and construed in accordance with laws of the State of Ohio, USA. For global complaints that cannot be resolved between Traveline Travel Services and the complainant, Traveline Travel Services has agreed to participate in the dispute resolution procedures of the panel established by the European data protection authorities to resolve disputes pursuant to the Safe Harbor Privacy Principles.


VI. Internet Privacy
Traveline Travel Services sees the Internet, Intranets and the use of other technologies as valuable tools for communicating and interacting with consumers. Traveline Travel Services recognizes the importance of maintaining the privacy of PII/SPII collected through its platform and services and web sites that it operates. Visitors on the Web may elect to voluntarily provide PII/SPII via the Traveline Travel Services platform and services, but are not required to do so. In general, Traveline Travel Services collects PII/SPII for the purpose of maintaining an effective business relationship with its customers; i.e. to perform services contracted with customers in our role as a Travel Management Company. Traveline Travel Services does not permit any confidential company or PII/SPII of our customers to be shared with or sold to third parties. Traveline Travel Services will only share such information with third parties at the specific written request of the customer, and/or as directed in legal contracts between the customer and a third party.
Traveline Travel Services respects the right to privacy of all individuals. However, in certain circumstances, we may disclose PII/SPII to government authorities or as dictated by legal obligation.
Traveline Travel Services may also collect anonymous information concerning web site users through the use of "cookies". "Cookies" are small files that web sites place on users' computers to identify the user and enhance the web site experience. Visitors may set their browsers to provide notice before they receive a cookie, giving them opportunity to decide whether to accept the cookie. A visitor can also set their browser to turn off cookies. If visitors do so, however, some areas of Traveline Travel Services platform and services may not function properly.
Traveline Travel Services customers have the option to request that Traveline Travel Services not use, correct or remove information previously provided to Traveline Travel Services. Customers who would like to correct or suppress information they have provided to Traveline Travel Services should forward such requests to Traveline Travel Services, Account Management, 4074 Erie Street, Willoughby, OH 44094.
Traveline Travel Services's platforms and services may contain links to other "Non-Traveline Travel Services" applications and web sites. Traveline Travel Services assumes no responsibility for the content or the privacy policies and practices of those web sites. Traveline Travel Services encourages all users to read the privacy statements of those sites; their privacy practices may differ from those of Traveline Travel Services.

VIII. Changes to this Safe Harbor Privacy Policy
The practices described in this Policy are current Personal data protection policies as of May 19, 2015. Traveline Travel Services reserves the right to modify or amend this Policy at any time consistent with the requirements of the U.S.-EU Safe Harbor Framework. Appropriate public notice will be given concerning such amendments.


IX. Safe Harbor Enforcement
Traveline Travel Services is compliant under U.S.-EU Safe Harbor Framework as outlined by the U.S. Department of Commerce. Any disputes that arrive from the passing of PII/SPII will be investigated and resolved.
